Terms of Service

These Terms of Service ("Terms") govern your use of the GIGACHAD mobile app and the website at gigachadapp.com (together, the "Service"), operated by GIGACHAD ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that happen under your account. Notify us at security@gigachadapp.com immediately if you suspect unauthorized use.
3. Health, safety, and assumption of risk
GIGACHAD provides educational and fitness content. Nothing in the Service is medical, nutritional, psychological, or therapeutic advice. The Service is not a substitute for consultation with a qualified healthcare professional.
3.1 Consult a healthcare provider
Before starting any exercise program featured in the Service, consult a qualified healthcare provider — especially if you are pregnant, have or have had a cardiac condition, high blood pressure, diabetes, a respiratory condition, a musculoskeletal injury, an eating disorder, or any other condition that could be affected by physical activity. If you are recovering from an injury or returning to training after a long break, seek medical clearance before starting.
3.2 Assumption of risk
You acknowledge that physical exercise carries inherent risks, including but not limited to: muscle strain, sprains, fractures, tendon and ligament injuries, cardiac events, loss of consciousness, and in rare cases serious injury or death. You voluntarily assume all such risks when performing any exercise, workout, stretch, lifting technique, program, or other activity described, recommended, or programmed by the Service. You are solely responsible for your own safety and for choosing exercises and loads appropriate to your fitness level and health status.
3.3 Stop if something feels wrong
If you feel pain, dizziness, shortness of breath, chest tightness, nausea, lightheadedness, or any other warning sign during a workout, stop immediately and seek medical attention if needed. Do not continue through pain that feels like injury. The Service cannot observe you, cannot assess your form in real time, and cannot respond to emergencies.
3.4 Release and waiver of claims
To the fullest extent permitted by law, you release, waive, and discharge GIGACHAD and its owners, operators, employees, contractors, and affiliates from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to your participation in any exercise, program, or activity described in the Service, including claims based on ordinary negligence. This release does not apply to claims for gross negligence, willful misconduct, or any liability that cannot be waived under applicable law.
3.5 Not medical, nutritional, or psychological advice
Articles about skin care, hair care, sleep, mindset, nutrition, and related topics reflect general information and opinion, not professional advice tailored to your situation. Always consult a qualified professional for issues affecting your health. Nothing in the Service diagnoses, treats, cures, or prevents any medical condition.
4. Subscriptions and payments
GIGACHAD offers paid subscriptions that unlock additional features. Subscriptions are billed through Apple (for iOS), Google (for Android), or a payment processor (for web). You may also purchase non-subscription credits for specific features like form check reviews.
- Free trial. A free trial, when offered, automatically converts to a paid subscription at the end of the trial period unless cancelled.
- Auto-renewal. Subscriptions auto-renew at the end of each billing period. You can cancel any time through your app store account.
- Refunds. Subscription refund requests are handled by Apple, Google, or the relevant payment processor under their respective policies. Credits purchased are non-refundable except where required by law.
- Price changes. We may change subscription prices with at least 30 days' notice. Your existing billing period is not affected; new prices take effect at renewal.
5. User content
You may upload progress photos, form check videos, and other content to the Service. You retain ownership of your content. By uploading, you grant us a limited license to store, process, and display that content within the Service for the purpose of providing it to you. We do not claim ownership, we do not relicense your content, and we do not use it for marketing without separate explicit consent.
6. Product links
The Self Care articles in the Service contain occasional recommendations for products from third-party retailers. Some of those links are affiliate links. If you make a purchase after tapping an affiliate link, we may earn a commission at no cost to you. As an Amazon Associate we earn from qualifying purchases. We have no control over the availability, pricing, shipping, warranty, or return policy of any third-party retailer. Disputes about a product or order are between you and the retailer.
7. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable law
- Attempt to reverse engineer, decompile, or extract source code from the app
- Use automated scripts, bots, or crawlers to access the Service without our written consent
- Upload content that is defamatory, obscene, harassing, or violates someone else's rights
- Impersonate another person or misrepresent your affiliation with anyone
- Attempt to gain unauthorized access to any part of the Service
8. Intellectual property
The Service — including the app, the website, the GIGACHAD trademark, all articles, programs, exercise descriptions, photographs, illustrations, code, and UI — is owned by GIGACHAD or its licensors and is protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not reproduce, republish, or redistribute our content without written permission.
9. Third-party services
The Service integrates with third-party services including Supabase, RevenueCat, PostHog, Sentry, Apple App Store, Google Play, and various affiliate networks. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, terms, or practices of third-party services.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for operational reasons (for example, discontinuing the Service). On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — intellectual property, disclaimers, limitations, indemnity, dispute resolution — will survive.
11. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT IS ACCURATE OR CURRENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGACHAD, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
13. Indemnity
You agree to indemnify and hold harmless GIGACHAD and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorney fees) that arise from your violation of these Terms, your misuse of the Service, or your violation of a third party's rights.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Service will be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction in those courts. Nothing in this section limits your right to seek relief from a small-claims court or any right you have under applicable consumer protection laws.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you through the app and update the "Last updated" date above. Continued use of the Service after an update means you accept the revised Terms.
